Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Peachbend’s website, applications, and related services (together, the “Services”).
1. Acceptance of Terms
By accessing or using Peachbend, you agree to these Terms and to our Privacy Policy, which explains how we collect and handle personal information. If you do not agree, do not use the Services.
If you use Peachbend on behalf of a school, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Peachbend
Peachbend is an AI-assisted education platform. It helps users turn learning materials into structured lessons and related educational content. Depending on the features available to your account, you may upload or provide documents, PDFs, notes, images, slides, text, links (including web pages, YouTube, and Google Drive or Google Workspace files when you use Google Sign-In), audio, and some video files, and Peachbend may generate lessons, explanations, summaries, quizzes, flashcards, diagrams, presentations, and other study or teaching materials.
Teachers and similar administrators on eligible plans may create student/viewer accounts, assign lessons, and manage those learners. Access to the Services, or to particular features, may be limited from time to time (for example during invite-only periods).
Peachbend provides tools, not a guaranteed curriculum. Features may be added, changed, limited, or removed over time. We do not promise that any particular feature will remain available in its current form.
3. Accounts
You may create an account with an email address and password, or sign in with Google Sign-In. You are responsible for providing accurate information where Peachbend asks for it, for keeping your credentials confidential, and for activity that occurs through your account. Ordinary Google Sign-In requests identity information only; Drive permission is requested separately if you choose to add a private Google file as a learning source.
If you believe your account has been compromised, notify us at [email protected] and, if you are signed in, review or revoke other sessions from your account settings. If you use Google Sign-In, you also manage Google sign-in security through your Google Account.
4. Teachers, Students, and Managed Accounts
On eligible plans, a teacher or similar administrator can create student/viewer accounts, assign lessons (including personalized versions), and deactivate those accounts. Viewer accounts typically have more limited permissions than independent learner or teacher accounts — for example, they may study assigned lessons rather than create the same range of materials.
You must be legally able to enter into these Terms. Where you cannot independently consent to use the Services under the laws that apply to you, you may use Peachbend only with appropriate authorization from a parent, guardian, school, teacher, or other legally authorized party.
If you create or manage accounts for other people, or upload their materials, you are responsible for having the legal authority and any required notices or consents to do so. That includes teachers, schools, organizations, tutors, and parents or guardians acting for learners they are authorized to represent.
These Terms do not claim that Peachbend is certified or compliant under COPPA, FERPA, GDPR-K, or any similar education-privacy or children’s-privacy regime.
5. User Content and Uploaded Materials
“User Content” means materials you (or someone using an account you manage) upload, submit, paste, link, record, or otherwise provide to Peachbend. That includes source files, notes, images, audio, prompts, chat messages, profile information you add, and similar inputs.
You retain ownership of your original User Content. You grant Peachbend a limited, worldwide, non-exclusive license to host, store, reproduce, process, transmit, transform, display, and otherwise use User Content only as reasonably necessary to operate, provide, maintain, secure, support, and deliver the Peachbend functionality you request — including generating requested outputs and enabling teacher assignments — subject to the Privacy Policy. This license is not a grant of rights for Peachbend to use User Content to train models or for unrelated secondary purposes.
You are responsible for ensuring you have the rights or authorization needed to provide User Content to Peachbend. You must not upload material that unlawfully infringes copyrights, privacy rights, publicity rights, or other rights, or that you are not allowed to process with third-party AI providers.
6. AI Processing and Generated Content
Peachbend uses artificial intelligence and other automated systems to read sources, generate lessons and practice materials, power chat, and (when enabled) create images, transcriptions, or spoken audio. As described in the Privacy Policy, User Content and related instructions may be sent to third-party AI and infrastructure providers to fulfill your requests.
AI-generated content:
- May contain mistakes or outdated information
- May omit relevant material from your sources
- May occasionally be misleading or inaccurate
- Should be reviewed by you whenever accuracy matters
- Should not be treated automatically as an authoritative academic source
Outputs are generated to assist teaching and learning. Peachbend does not guarantee that outputs are unique, complete, or factually correct.
7. Educational Disclaimer
Peachbend is an educational technology tool. It does not guarantee particular grades, examination results, academic performance, learning outcomes, admission outcomes, or professional qualifications. Teachers and learners remain responsible for deciding whether generated materials are accurate, age-appropriate, and suitable for their educational context.
8. Acceptable Use
You may use Peachbend for lawful educational and related purposes. You must not:
- Violate applicable law
- Infringe intellectual-property or privacy rights
- Upload material you do not have permission to process
- Circumvent usage limits, quotas, or plan restrictions
- Abuse, disrupt, overload, or attack the Services
- Attempt unauthorized access to accounts, systems, or data
- Distribute malware or harmful code
- Reverse engineer restricted portions of the Services except where applicable law allows
- Use automated systems to scrape or abuse Peachbend outside the interfaces we provide
- Impersonate others or misuse another person’s account
- Attempt to bypass security or authentication controls
Normal classroom, tutoring, homeschool, and personal-study use of the product features we provide is permitted, including generating lessons from materials you are allowed to use.
9. Intellectual Property
Peachbend’s software, branding, names, logos, interface, designs, documentation, and original service content belong to Peachbend or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Peachbend’s intellectual property to you.
User Content remains yours as described in Section 5. Peachbend does not claim ownership of your original uploaded materials.
10. AI Output and Ownership
Subject to applicable law, third-party rights, and these Terms, you may generally use outputs generated for you through Peachbend for your own educational and teaching purposes, including downloading exports the product makes available to your plan (such as PDF, Markdown, DOCX, or PPTX where enabled).
Peachbend does not guarantee that you have exclusive copyright in AI-generated material, that copyright necessarily exists in a given output, or that the same or similar content will not be generated for other users. Peachbend can transfer only rights it actually has.
11. Copyright and Intellectual Property Complaints
If you believe User Content on Peachbend infringes your rights, email [email protected] with a description of the work, the material you believe is infringing, its location in the Services if known, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will review complete notices and may remove or disable access to material where appropriate.
12. Plans, Usage Limits, and Paid Services
Peachbend may offer free and paid plans. Plans may include limits on lessons, Content Creator outputs, uploads, storage, viewer accounts, AI visuals, narration, and other features. Some capabilities (for example Teacher Management) may require an eligible plan.
Current prices, included features, and limits are shown on the pricing page and in the product. They may change independently of these Terms.
13. Billing, Renewals, Cancellation, and Refunds
Peachbend may offer paid services. If you purchase a paid plan or other paid feature, the applicable price, billing period, renewal, cancellation, tax, and refund terms will be disclosed to you before you complete the purchase, including on the pricing page or at checkout.
Payment processing, if used, may be handled by a third-party provider. Peachbend does not itself store full payment-card numbers.
14. Changes to Pricing and Plans
Peachbend may change prices, plan structures, usage limits, and included features. Changes that affect an existing paid subscription will be handled according to applicable law and any notice we are required to give. We will not treat a change as rewriting what you already received for a period that has already been paid, except as allowed by applicable law.
15. Third-Party Services
Peachbend relies on third parties to operate, including authentication (Google, if you use Google Sign-In), AI and model providers, hosting and cloud infrastructure, email delivery, and search or media helpers such as YouTube. If you purchase paid services, a payment provider’s terms may also apply. Use of those services may be subject to their own terms and privacy policies. Peachbend is not responsible for third-party services we do not control.
16. Service Availability and Changes
We may modify the Services, update or discontinue features, and perform maintenance. We do not guarantee uninterrupted, timely, or error-free operation. Scheduled or emergency downtime may occur.
17. Account Suspension and Termination
Peachbend may suspend or terminate access if we reasonably believe there is a material violation of these Terms, fraud, a security threat, abuse, illegal activity, or nonpayment for paid services. We aim to use this only where needed to protect users or the Services, not as an unlimited convenience right.
After termination, you will lose access to the product through that account. Uploads, lessons, and conversations associated with the account are handled as described in the Privacy Policy.
18. User Cancellation and Account Deletion
Stopping use of Peachbend, disconnecting Google, canceling a paid service, and deleting an account are different actions:
- You can stop using the Services at any time by signing out and not returning.
- You can revoke Peachbend’s Google access in your Google Account. That may stop Google Sign-In and Peachbend’s ability to retrieve Google Drive or Google Workspace files you add as sources. It does not by itself delete your Peachbend account or saved content.
- Canceling a paid subscription, if you have one, does not automatically delete your Peachbend account unless we say so in the purchase terms presented at the time of sale.
- To request deletion of your Peachbend account and associated personal information, email [email protected]. Signed-in users can also delete individual uploads, saved lessons, and creator conversations from the product. Teachers may deactivate viewer accounts they manage. See the Privacy Policy for how deletion and retention work.
19. Disclaimers
Peachbend is provided on an “as is” and “as available” basis to the extent permitted by law. We do not warrant that the Services or any AI output will be accurate, complete, uninterrupted, secure, or fit for a particular educational purpose, or that third-party services will perform without error. You are responsible for reviewing generated materials before relying on them.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Peachbend and its operators will not be liable for lost profits, lost data, replacement-content costs, or indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or from AI-generated materials.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those places, the limitations in these Terms apply only to the extent permitted. Nothing in these Terms is intended to exclude liability that cannot legally be excluded, such as liability for fraud or for death or personal injury caused by negligence where such a rule applies.
21. Indemnification
If you are using Peachbend in a professional, school, or organizational capacity, you agree to defend and indemnify Peachbend against claims, damages, and reasonable expenses arising from User Content you supply, your unlawful use of the Services, a material violation of these Terms, or alleged infringement caused by content you provided, to the extent permitted by law.
This section is not intended as a broad consumer waiver of rights you cannot legally give up.
22. Consumer Rights
If you use Peachbend as a consumer, nothing in these Terms excludes rights that cannot legally be waived under the consumer-protection or other mandatory laws that apply to you. If a court finds a provision unenforceable, the rest of the Terms continue to apply.
23. Changes to These Terms
We may update these Terms. The “Last updated” date at the top of this page will change when we do. For material changes we may provide additional notice where required or appropriate, such as a notice in the product. Continued use after an update means you are using Peachbend under the revised Terms, except where applicable law says otherwise.
